These Terms and Conditions set out the basis on which Waste Clearance Belgravia provides waste collection and clearance services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following definitions apply:
Customer means any individual, business or organisation that requests or receives waste clearance or related services from Waste Clearance Belgravia.
Services means waste collection, waste clearance, rubbish removal, loading, transportation, and disposal or recycling services provided by Waste Clearance Belgravia.
Booking means a confirmed request for Services made by the Customer by telephone, email, online form or other agreed method.
Waste means any items, materials, rubbish, junk, furniture, appliances, garden waste, construction waste or other matter to be removed as part of the Services, excluding prohibited items as defined in these terms.
Waste Clearance Belgravia provides non-hazardous waste collection and clearance services, including the loading, transportation and lawful disposal or recycling of Waste. We operate primarily within Belgravia and surrounding areas, although service coverage may vary and is subject to confirmation at the time of Booking.
The exact scope of Services, including the type and quantity of Waste to be collected, access requirements, and any additional labour or time required, will be agreed at the time of Booking or at the point of collection following an on-site assessment.
We reserve the right to refuse to collect any Waste that is unsafe to handle, prohibited by law, misdescribed, excessively heavy, contaminated, or otherwise unsuitable for collection or transport using our equipment and vehicles.
Bookings may be made by telephone, email or online enquiry. When making a Booking, the Customer must provide accurate and complete information about:
The collection address and any access restrictions.
The nature, approximate volume and type of Waste to be collected.
Any special requirements, such as time constraints, parking limitations, or property protection needs.
All Bookings are subject to availability. We will confirm the Booking by providing a collection date and time window, together with an estimated price based on the information supplied. Any estimated price is indicative only and may be revised if the Waste differs substantially from the description given at the time of Booking.
The Customer is responsible for ensuring that any person making the Booking on their behalf is authorised to do so and to bind the Customer to these Terms and Conditions.
The Customer must ensure that our operatives have safe, reasonable and uninterrupted access to the property and the Waste at the agreed collection time.
The Customer is responsible for arranging suitable parking or access for our vehicle as close as practicable to the collection point. Any parking charges, permits, fines or penalties incurred due to restrictions or failure to provide adequate parking information may be charged to the Customer.
The Customer must ensure that the Waste is clearly identified and separated from any items that are not to be removed. Waste Clearance Belgravia will not be liable for removing items that the Customer failed to distinguish from the Waste.
The Customer warrants that they either own the Waste and items to be removed or have full authority from the legal owner to request their removal. The Customer agrees to indemnify us against any claim or loss arising from removal of items where such authority was lacking.
Our charges may be based on factors including, but not limited to, the volume and type of Waste, weight, loading time, access conditions, and any additional labour or services requested by the Customer.
Unless otherwise agreed, prices quoted prior to collection are estimates only and may change following inspection of the Waste on site. If the price needs to be adjusted due to inaccurate description, increased volume or other unforeseen circumstances, we will inform the Customer and seek approval before proceeding. If the Customer does not agree to the revised price, we may cancel the Booking, and a call-out or cancellation fee may apply.
Payment is due on completion of the Services, unless a prior written agreement for credit terms has been made. We may accept payment by cash, debit card, credit card or bank transfer, subject to availability and any applicable processing charges.
For business customers with agreed credit terms, invoices are payable within the period stated on the invoice. We reserve the right to charge interest on overdue sums at the statutory rate permitted under UK law, together with reasonable recovery costs.
The Customer may cancel or reschedule a Booking by giving us reasonable notice using the same contact details used for the original Booking or other agreed contact channels.
Where the Customer cancels less than 24 hours before the scheduled collection time, we reserve the right to charge a cancellation fee to cover our administrative and operational costs.
If our team arrives at the collection address at the agreed time and is unable to gain access, unable to contact the Customer, or the Waste is not available for collection, we may treat the Booking as cancelled by the Customer and charge a call-out or cancellation fee.
Waiting time charges may be applied if our operatives are delayed on-site due to access issues, lack of preparation, or other reasons beyond our control.
We will endeavour to attend at the agreed time, but any times given are estimates only and may be affected by traffic, weather, operational demands or other circumstances. We are not liable for any loss arising from delay or rescheduling, but we will inform the Customer as soon as reasonably practicable if a significant delay is expected.
Due to legal and safety requirements, certain types of waste cannot be collected or can only be collected under specific arrangements. Prohibited or restricted items may include, but are not limited to:
Hazardous, toxic or clinical waste, including chemicals, solvents, paints, oils, asbestos, medical waste and flammable substances.
Gas cylinders, pressurised containers and certain electrical or electronic items that require special handling.
Items or materials that are excessively heavy or bulky for safe manual handling or that cannot be safely loaded into our vehicles.
If such items are present at the time of collection, we may refuse to collect them, adjust the price, or cancel the Booking. The Customer is responsible for informing us in advance if any potentially hazardous or unusual items are included in the Waste.
Waste Clearance Belgravia operates in accordance with applicable UK waste management legislation and regulations. We aim to ensure that Waste collected from customers is managed responsibly and, where possible, diverted from landfill through reuse or recycling.
We will transport Waste only to licensed disposal, recycling or transfer facilities, and we will maintain appropriate records to demonstrate lawful handling. By using our Services, the Customer authorises us to decide, at our discretion, how the Waste will be sorted, treated, recycled or disposed of, subject to legal requirements.
The Customer agrees not to place in the Waste any items that are illegal to possess or dispose of, and confirms that the Waste does not contain hidden hazardous materials. If we discover such items after collection, we may notify the relevant authorities and charge the Customer for any additional handling, disposal and legal costs.
We will take reasonable care when carrying out the Services to avoid damage to property, fixtures and fittings. However, the Customer is responsible for protecting floors, walls, doorways and other surfaces if they are concerned about potential marks or minor scuffs arising from normal handling of Waste.
Our liability for loss or damage caused by our negligence or breach of contract is limited to the direct cost of repair or replacement, subject to a fair assessment of wear, age and condition. We are not liable for any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity.
We are not responsible for loss or damage resulting from:
Pre-existing defects, structural weaknesses or unsafe conditions at the property.
Failure by the Customer to provide accurate information about access or the nature of the Waste.
Instructions or requests made by the Customer that require us to carry items through narrow or restricted spaces where reasonable risk of damage cannot be avoided.
Any event beyond our reasonable control, including severe weather, traffic disruption, vehicle breakdown, strikes or other force majeure events.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be limited or excluded under applicable law.
The Customer agrees to indemnify and hold harmless Waste Clearance Belgravia, its employees and agents from and against all claims, losses, damages, expenses and liabilities arising from:
Breach by the Customer of these Terms and Conditions.
Misrepresentation of the nature, ownership or legality of the Waste.
Injury or loss arising from unsafe conditions at the collection address not notified to us in advance.
Any fines, penalties or charges imposed due to the inclusion of prohibited or illegal items within the Waste.
If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible, providing full details of the issue and any supporting information. We will investigate the matter promptly and, where appropriate, seek to resolve it through correction, explanation, goodwill gesture or other fair remedy.
Raising a complaint does not entitle the Customer to withhold payment for Services properly rendered, unless and until we have agreed an adjustment or refund.
We will collect and use personal information about Customers only to the extent necessary to manage Bookings, provide Services, process payments and meet our legal obligations. We will keep such information secure and will not sell it to third parties.
We may share Customer data with trusted third parties such as payment processors, waste disposal facilities or regulatory bodies where required to deliver the Services or comply with the law.
We may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice or our service offering. The version in force at the time of your Booking will apply to that Booking. Updated terms may be made available on request or via our usual communication channels.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be deemed modified to the minimum extent necessary to make it valid and enforceable, or severed if such modification is not possible. The remaining provisions will continue in full force and effect.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions, the provision of waste clearance services, or any Booking made with Waste Clearance Belgravia.
These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between Waste Clearance Belgravia and the Customer in relation to the Services and supersede any prior discussions, correspondence or understandings between the parties.
No variation of these Terms and Conditions shall be effective unless it is in writing and expressly agreed by an authorised representative of Waste Clearance Belgravia.
